Terms of Service for CustomCurrency

1. Agreement to Terms

By downloading, installing, or using the CustomCurrency mobile application (“App,” “Service,” or “CustomCurrency”), you agree to be bound by these Terms of Service (“Terms”).
If you do not agree to these Terms, do not use the Service.

2. Description of Service

CustomCurrency is a mobile application that allows users to:

Create and manage custom digital currencies
Invite members to participate in currencies
Send and receive currency units between members
Set transaction limits and manage permissions
Create earning opportunities and rewards programs
Track transaction history and analytics

Important: CustomCurrency tokens have no monetary value and cannot be exchanged for real currency, goods, or services outside the app.

3. Eligibility

You must be at least 13 years old to use CustomCurrency. By using the Service, you represent and warrant that:

You are at least 13 years of age
You have the legal capacity to enter into these Terms
You are not prohibited from using the Service under applicable laws
You will comply with all applicable laws and regulations

4. Account Registration

Account Creation

You must provide accurate, complete, and current information
You are responsible for maintaining the confidentiality of your password
You are responsible for all activities under your account
You must notify us immediately of any unauthorized use

Account Security

Choose a strong, unique password
Do not share your account credentials
We are not liable for any loss from unauthorized account access

Demo Accounts

Demo accounts are for testing purposes only and may be reset or removed at any time without notice.

5. Acceptable Use Policy

You May:

Create currencies for legitimate community, family, or organizational purposes
Use the reward system for positive reinforcement and engagement
Share currencies with consenting members
Export your transaction data for personal records

You May Not:

Use CustomCurrency for illegal activities
Create currencies that promote discrimination, harassment, or hate
Impersonate others or create fake accounts
Use the Service for gambling or betting
Attempt to exchange CustomCurrency tokens for real money
Circumvent security features or access restrictions
Use automated systems or bots without permission
Violate any third party’s rights
Upload malicious code or interfere with the Service
Use the Service for commercial purposes without authorization

6. Currency Creation and Management

As a Currency Owner:

You are responsible for managing your currency appropriately
You must clearly communicate the purpose and rules to members
You cannot mislead members about the nature of the currency
You must respect member privacy and data

As a Currency Member:

You must follow the rules set by currency owners
You understand that balances can be adjusted by administrators
You acknowledge that currencies may be deleted by their owners

7. Intellectual Property Rights

Our Rights:

CustomCurrency and its original content, features, and functionality are owned by us
The Service is protected by copyright, trademark, and other laws
Our trademarks and trade dress may not be used without permission

Your Rights:

You retain ownership of content you create (currency names, descriptions, etc.)
You grant us a non-exclusive, royalty-free, worldwide, sublicensable license to use, display, and distribute your content within the Service

Feedback:
Any feedback, suggestions, or ideas you provide become our property and may be used without compensation to you.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using CustomCurrency, you consent to our collection and use of data as described in the Privacy Policy.

9. Third-Party Services

The Service may contain links to or integrate with third-party services. We are not responsible for:

The content or practices of third-party services
Any damage or loss from your use of third-party services
Privacy policies of third-party providers

10. Disclaimers

No Financial Value:
CustomCurrency tokens are digital units for tracking only. They:

Have no monetary value
Cannot be redeemed for money
Are not cryptocurrency or digital assets
Should not be considered an investment

Service Availability:

The Service is provided “AS IS” and “AS AVAILABLE”
We do not guarantee uninterrupted or error-free operation
We may modify or discontinue features without notice
We are not responsible for data loss

No Warranties:
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability of content

11. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for any indirect, incidental, special, or consequential damages
Our total liability shall not exceed $100 or the amount paid by you in the past 12 months
We are not liable for loss of data, profits, or business interruption
These limitations apply even if we have been advised of the possibility of damages

12. Indemnification

You agree to indemnify, defend, and hold harmless CustomCurrency, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Content you post or share through the Service

13. Termination

By You:
You may terminate your account at any time by:

Deleting your account through the app settings
Contacting us at support@customcurrency.app

By Us:
We may terminate or suspend your account immediately, without prior notice, if:

You breach these Terms
We are required to by law
We discontinue the Service
Continued provision would be commercially unreasonable

Effects of Termination:

Your access to the Service will cease
Your data may be deleted after 30 days
Provisions that should survive will remain in effect

14. Dispute Resolution

Informal Resolution:
Before filing a claim, you agree to try to resolve disputes informally by contacting us at legal@customcurrency.app.

Arbitration:
Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

Exceptions:

Small claims court actions
Injunctive relief for intellectual property violations

Class Action Waiver:
You agree to resolve disputes individually and waive the right to participate in class actions.

15. General Provisions

Governing Law: These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles.
Entire Agreement: These Terms constitute the entire agreement between you and CustomCurrency.
Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.

Continued use after changes constitutes acceptance of the new Terms.

16. Special Provisions

TestFlight/Beta Testing:
Beta versions may be unstable and data may be lost. Participation in beta testing is at your own risk.

Export Controls:
You agree to comply with all applicable export and re-export control laws.

Government Users:
If you are a government entity, additional terms may apply.
